These Terms and Conditions ("Terms") govern your use of the SnowFoam UK website (snowfoam.uk) and the purchase of products from us. Please read them carefully before placing an order.

By using our website or placing an order, you agree to these Terms. If you do not agree, please do not use the website.

Our website is powered by Shopify. Any purchase you make through the website is a contract between you and Em Truck Stop Ltd, not Shopify.

Who These Terms Apply To

These Terms apply to both:

• Consumers (individuals buying for personal use, outside of a business)
• Trade customers (businesses, sole traders, fleet operators and trade accounts)

Certain sections apply only to consumers or only to trade customers, and these are clearly identified.

Your Account

To place orders, save wishlists or apply for a trade account, you may need to create an account. You are responsible for:

• Providing accurate, current and complete information
• Keeping your account password confidential
• All activity that takes place under your account

You must be at least 18 years old to create an account or place an order.

You must not transfer, sell, or share your account with anyone else.

Our Products

We make every effort to display our products accurately. However, product colours, packaging and appearance may differ slightly on your device due to screen settings.

We reserve the right to:

• Change product descriptions, specifications or packaging without notice
• Discontinue products at any time
• Limit order quantities for any product, customer or region at our discretion

All products are supplied subject to availability. If a product is unavailable after you order, we will contact you to arrange a refund or alternative.

Orders

When you place an order through our website, you are making an offer to purchase. Your order is an offer to buy. A contract is formed only when we dispatch the goods or expressly confirm acceptance after review.

This means an automated order confirmation email does not form a binding contract. It confirms we have received your order, but we reserve the right to review and accept or decline it before dispatch.

We may refuse or cancel any order at our discretion before dispatch, including where:

• The product is out of stock
• There is a pricing or description error
• Payment has not been received or authorised
• We suspect fraud or misuse of promotions
• The order breaches these Terms

If we cancel an order before dispatch, we will refund any payment taken in full.

Pricing and Payment

All prices on our website are shown in GBP and include UK VAT at the prevailing rate where applicable. Delivery charges are additional and shown at checkout.

Prices may change without notice. The price charged will be the price in effect at the time your order is placed, as confirmed in your order confirmation.

We accept payment via Shopify Payments, PayPal, Klarna, Shop Pay, Apple Pay, Google Pay and other methods shown at checkout. Payment must be received and authorised before we accept your order.

You confirm that:

• The payment card or method you use is yours or you are authorised to use it
• All information you provide is accurate and complete
• You will pay all charges including the product price, taxes and delivery charges

If a pricing error is discovered after your order is placed, we will contact you to confirm whether you wish to proceed at the correct price or cancel.

Promotions and Discount Codes

From time to time we may run promotions, sales or offer discount codes. These are subject to the following:

• Promotions and discount codes may be withdrawn, amended or refused where misuse, duplication, abuse or technical error occurs
• Codes cannot be combined with other offers unless expressly stated
• Codes have no cash value and cannot be exchanged for cash
• Codes may have a minimum spend, expiry date, product category restriction or one-use-per-customer limit
• We reserve the right to cancel or refuse orders where we reasonably believe a code has been misused or obtained improperly

Delivery

Delivery terms are set out in our Delivery Information page. Delivery times are estimates and not guaranteed.

Risk in the goods passes to you when the goods are delivered to the delivery address you provided. If you request delivery to a safe place, neighbour or InPost locker, delivery may be deemed completed once the goods are left as instructed. Ownership of the goods passes to you once we have received full payment.

We are not liable for delays outside our reasonable control, including courier delays, strikes, adverse weather or force majeure events.

Damaged, Faulty or Incorrect Goods

If your goods arrive damaged, faulty or incorrect, contact us promptly with your order number and photos where possible. Email info@snowfoam.uk within 48 hours of delivery for damaged goods, or as soon as reasonably possible for faults identified later.

We will arrange a replacement, repair or refund in line with your statutory rights and our Returns & Refunds policy.

Consumer Returns and Cancellation

If you are a consumer (buying for personal use outside of a business), you have the right under UK Consumer Contracts Regulations 2013 to cancel your order within 14 days of receiving the goods, without giving a reason.

Some products (including opened chemicals, tamper-sealed items and custom orders) are excluded from the right to cancel for hygiene and safety reasons.

Trade Customers

If you buy from us in the course of a business, as a sole trader, trade account holder or for commercial resupply, different terms apply:

• The 14-day cancellation right under the Consumer Contracts Regulations 2013 does not apply (B2B sales)
• Returns for change of mind are at our discretion and may incur restocking charges
• Faulty goods are covered by separate terms, including the Sale of Goods Act 1979 (as amended) and our trade account agreement
• Liability limits differ. See "Liability" section below.

Trade accounts are subject to separate terms agreed at account setup. Contact info@snowfoam.uk for trade enquiries.

Consumer Rights

If you are a consumer, you have statutory rights under the Consumer Rights Act 2015 that cannot be excluded. In particular, we must supply products that are:

• Of satisfactory quality
• Fit for purpose
• As described

Nothing in these Terms affects your statutory rights as a consumer. If you are a consumer, mandatory rights in your home jurisdiction remain unaffected by these Terms. For more information on consumer rights, visit the Citizens Advice website.

Product Use and Safety

Our products are cleaning chemicals intended for professional and domestic vehicle cleaning. You are responsible for:

• Reading and following all product labels, safety data sheets and instructions
• Always testing products on an inconspicuous area first where appropriate, particularly for wheel cleaners, degreasers and strong detergents
• Using appropriate PPE (gloves, eye protection) when handling concentrated chemicals
• Storing products safely and out of reach of children and pets
• Diluting products correctly before use
• Not mixing products unless specifically instructed

We cannot accept liability for damage caused by misuse, incorrect dilution, failure to test first, or failure to follow product instructions.

Safety Data Sheets (SDS) are available on request at info@snowfoam.uk and may be supplied with relevant trade products where required under UK CLP regulations.

Intellectual Property

All content on our website, including text, images, logos, product photography, design and layout, is owned by Em Truck Stop Ltd or our licensors and is protected by UK and international copyright, trademark and other intellectual property laws.

You may view, download and print content for personal, non-commercial use only. You must not:

• Copy, reproduce or republish content for commercial purposes
• Remove copyright or trademark notices
• Scrape, harvest or systematically extract content using automated tools or AI agents
• Use our trademarks, logos or brand names without written permission

Third-party brands and product names shown on our website (including Nerta and other manufacturers) are the property of their respective owners.

Third-Party Websites and Links

Our website may contain links to third-party websites or services. We have no control over these sites and are not responsible for their content, privacy practices or terms of use. Accessing third-party sites is at your own risk.

Prohibited Use

You must not use our website:

• For any unlawful purpose
• In a way that breaches any UK, EU or international law
• To transmit viruses, malware or harmful code
• To harass, abuse or harm any person
• To impersonate another person or entity
• To scrape, copy or extract content without permission
• To use automated tools or AI agents in a way that disguises their nature
• To circumvent security features or access restrictions

We reserve the right to restrict, suspend or terminate your access to the website if we reasonably believe you have breached these Terms.

AI and Automated Agents

If you use, deploy or enable any software agent (including AI agents) to access our website on your behalf:

• The agent must identify itself clearly in HTTP headers as an automated system
• The agent must not mimic human behaviour or bypass CAPTCHAs or access controls
• The agent must respect robots.txt and other technical measures
• You remain responsible for all actions taken by agents on your behalf

We may block or restrict agents at our discretion.

Feedback and Reviews

If you submit reviews, ratings, comments, suggestions or other content to our website ("Feedback"), you grant us a non-exclusive, worldwide, royalty-free licence to use, publish and display that Feedback in connection with our business.

You confirm that:

• The Feedback is your own original content
• You have disclosed any connection, compensation or incentive received in connection with the review
• The Feedback does not infringe any third-party rights
• The Feedback is not misleading, defamatory, offensive or unlawful

We may moderate, edit or remove Feedback at our discretion, but are under no obligation to do so.

Liability

Nothing in these Terms limits or excludes our liability for:

• Death or personal injury caused by our negligence
• Fraud or fraudulent misrepresentation
• Breach of your statutory consumer rights under the Consumer Rights Act 2015
• Defective products under the Consumer Protection Act 1987
• Any other liability that cannot be excluded by law

Subject to the above:

For consumers: We are responsible for losses that are a foreseeable result of our breach of these Terms or our negligence. Loss is foreseeable if it was an obvious consequence of our breach, or if it was contemplated by you and us at the time you placed the order. We are not responsible for unforeseeable loss, business loss (our products are for personal use unless you have a trade account), or loss caused by your failure to follow product instructions or reasonable care.

For trade customers: Our total liability for any claim arising under or in connection with these Terms or any order, whether in contract, tort (including negligence), misrepresentation or otherwise, is limited to the price paid for the goods giving rise to the claim. We are not liable for any indirect, consequential or economic loss, including loss of profit, business interruption, loss of data, or loss of opportunity, even if advised of the possibility.

We are not liable for any loss caused by your failure to follow product instructions, safety data sheets or reasonable care when using our products.

Indemnity (Trade Customers Only)

If you are a trade customer, you agree to indemnify Em Truck Stop Ltd against any claims, losses, damages or costs (including reasonable legal fees) arising from:

• Your breach of these Terms
• Your breach of any third-party rights
• Your use of our products in breach of the product instructions or safety data sheets
• Your use of our website in breach of applicable law

This indemnity does not apply to consumer customers.

Privacy

Your personal data is handled in accordance with our Privacy Policy.

Termination

We may suspend or terminate your access to our website at any time without notice if:

• You breach these Terms
• We suspect fraud or unlawful activity
• We are required to do so by law

Termination does not affect any rights or obligations accrued before termination. Sections of these Terms intended to survive termination (including Intellectual Property, Liability, Indemnity, Privacy and Governing Law) will continue to apply.

Changes to These Terms

We may update these Terms from time to time to reflect changes in our business, services or legal requirements. The updated version will be posted on this page with a revised "Last updated" date.

Your continued use of the website after changes are posted means you accept the revised Terms.

Severability

If any part of these Terms is found to be unlawful, void or unenforceable, that part will be treated as removed. The remaining provisions will continue in full force.

Entire Agreement

These Terms, together with our Privacy Policy, Returns & Refunds Policy and Delivery Information, form the entire agreement between you and Em Truck Stop Ltd in relation to your use of our website and any purchase.

Assignment

You may not transfer or assign your rights or obligations under these Terms without our written consent. We may transfer our rights and obligations to another company in connection with a sale, merger or restructuring of our business.

Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer resident in Scotland or Northern Ireland, you may bring proceedings in your local courts. Mandatory consumer rights in your home jurisdiction remain unaffected by these Terms.
